Using our Services
Please read this Agreement carefully before accessing or using any of our Services. By accessing or using any of them, you agree to become bound by the Terms of Service. If you do not agree to all the Terms of Service, then you may not access any of our Services. Violation of any of them may result in the termination of your account.
Your Bear CMS Account
You may need a Bear CMS account to use some of our Services. You are responsible for maintaining the security of your account and password. You are also responsible for keeping your account information updated (valid email address and billing information, for example). You are responsible for any activity that occurs through your Bear CMS account.
You are responsible for providing the necessary equipment (computer, smartphone, etc.) and Internet connection to access our services.
Your Content hosted by us
You are legally responsible for all content you've posted to our Services. You hereby grant Amplilabs Ltd. a worldwide, royalty-free, non-exclusive license to host and use your content to provide you with the Services and hereby represent and warrant that you have all the rights necessary to grant us such license. You are responsible for archiving your content regularly and frequently to prevent loss.
You are not allowed to publish content:
- that's contrarian to the Bulgarian legislation and applicable foreign laws
- that infringes copyrights or trademarks
- that violates human rights or freedoms
- that violates any property or non-property rights or legal interests of third parties
- that containing erotic, pornographic, or other adult content or containing links to such content
- that presents or promotes services for earning money from the Internet by clicking or viewing ads (paid to click) or programs for generating traffic (auto surf, traffic exchange)
- which may mislead visitors into believing that the website belongs to another person or organization
- that collects account information or passwords for other websites
- which are created for linking to other websites (link building)
- which contain misleading information for material gain
- that contains viruses, malware, hacks, or other destructive or dangerous content
- that's contrary to ethics, morality, and good manners
Paid services
We offer paid plans, upgrades, and addons that add features to your website. You choose the activation period and after we receive your payment the paid services are activated for the site specified.
You take full responsibility for all taxes and fees of any nature associated with using our Services.
A Bear CMS plan, upgrade, or addon can be renewed before the expiration date. It is disabled if the expiration date has passed and no renewal payment is received.
Paid services for websites hosted by us
A hosted website requires a paid plan to be publicly accessible. You can create a website for free, start adding content and browse it, but when shared publicly there will be a message that informs the visitors this site is in trial mode.
You can order Plan START, Plan PRO or Plan MAX and when paid, your site will be publicly accessible via the domain you've selected.
A free trial is available. Some of the website's functionalities are limited while in trial.
No refund option is available.
Paid services for self-hosted websites
You can self-host your website and use our CMS tools for free. There are paid plans that adds additional features. They requires payment before activation. A 14 days refund option is available.
We provide a collection of addons for the websites that use our services. Some of them are free. The paid ones require payment before activation. A refund policy is specified for each addon.
Domain registration
Additional terms for domains registered through our services:
- Submitting a domain registration request does not reserve the selected domain until it is paid for and registered.
- The provider is not responsible in cases where the selected domain is registered by another person before the user makes a payment and before the provider performs its registration.
- The domain name must not lead to infringement of intellectual property rights, personal rights, or other rights.
- The provider is not responsible if the personal data provided by the user is wrong, incomplete, or inaccurate and this leads to refusal of registration or termination of registration by the relevant registry.
- The provider is not responsible if the domain name was claimed/registered by a third party after the registration period expired, the renewal price is different, or the domain is deleted from the relevant registry due to late renewal payment.
- Access to the domain and its management may be suspended in cases of providing proof of trademark encroachment, court, or arbitration decision.
- For the undescribed cases, the laws of the Republic of Bulgaria and the rules of international organizations for the management of domain names apply.
No refund option is available when buying a domain through our services.
DNS Service
Bear CMS's DNS servers can only be used when the domain is registered through our services or the domain is mapped to a website hosted by us.
Modifying and Terminating our Services
We are constantly changing and improving our Services. We may add or remove functionalities or features, create new limits, and we may suspend or stop a service altogether. Amplilabs Ltd. may terminate your access to all or any part of our Services at any time, with or without cause, with or without notice, effective immediately.
Warranties and Disclaimers
Neither Amplilabs Ltd. nor its suppliers or distributors make any specific promises about the Services. We don't make any commitments about the content within the services, the specific functions of the services, or their reliability, availability, or ability to meet your needs. We provide the services "AS IS".
Liability for our Services
Amplilabs Ltd. and its suppliers and distributors will not be responsible for lost profits, revenues, or data, financial losses, or indirect, special, consequential, exemplary, or punitive damages.
Indemnification
You agree to indemnify and hold harmless Amplilabs Ltd., its contractors, its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of our Services, including but not limited to your violation of this Terms of Service.
Disputes
Any disputes arising shall be governed by the laws of the Republic of Bulgaria in courts located in Sofia, Bulgaria.
About these terms
We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.
